STOPPING for a curry cost drunken Mark Sydney-Smith more than a penny after he wet himself in a restaurant, a court heard.

The 38-year-old father-of-two stopped off at the Lahore take away in Regent Circus at 11.30pm on Sunday when the accident happened, magistrates were told.

Richard Thomas, prosecuting, said Sydney-Smith paid for his food and sat down waiting for it to be cooked.

He said: "He urinated himself in his trousers, his shoes and, problematically, the carpet of the restaurant. The owner of the restaurant noticed there was a wetness to the carpet which had just been cleaned at a cost of £51."

The restaurateur tried to throw Sydney-Smith out of the premises but he became abusive demanding his food, Mr Thomas said.

"He removed the remote control for the TV and left the premises, making some threats. He then returned and put it back and sat down and waited for the police to arrive."

When officers got there,Sydney-Smith, of Frobisher Drive, Walcot, was abusive and whispered threats and made signs at the restaurateur.

Martin Rae, defending, said his client was extremely drunk at the time of the offence and was embarrassed about what had happened.

He said that Sydney-Smith, who admitted criminal damage and a public order offence, would have left quietly apart from the fact that he knew his girlfriend would have been annoyed if he got home without the food.

Mr Rae added that his client had offered to pay for the cleaning of the carpet there and then but the restaurateur had been abusive and then called the police.

Magistrates put him on a one year conditional discharge and ordered he pay £51 compensation and £55 costs.
