A SWINDON man who downloaded child pornography by mistake walked free after judges overturned his three-month jail sentence and accepted he was not a paedophile.
Michael Saunders, 37, of William Street, pleaded guilty at Middlesex Guildhall Crown Court to five offences under the Protection of Children Act.
The Appeal Court in London heard that his interest in other types of porn led to the charges when images of adults committing sex acts with children were found on a disk belonging to him.
He was jailed on May 8 for three months with an extended licence for a year to run from his release, which meant he could have been recalled to prison if he put a foot wrong during that time.
But yesterday judges substituted his jail term for a one-year community rehabilitation order after hearing that he "was not a paedophile in denial".
