A WESTBURY man has been jailed for four months after clocking up his sixth conviction for driving while disqualified.

Friends reported Martin Penny to the police after he drove his Ford Orion home from The Hollies pub in Westbury Leigh on February 1. But although he had drunk between 10 and 12 pints of lager beforehand he was not breath tested as police were unaware of the incident until the next day.

Penny, 23, of Edward Street, ad-mitted driving while disqualified and driving without insurance at an earlier hearing, but the case was adjourned for reports until Monday.

Colin Meeke, prosecuting, said when Penny committed the offence last month he was subject to a two-year ban imposed in August 2002, and that disqualification was meted out after a he had breached another ban imposed in February 2001.

Tim Hammick, defending, said: "He was a complete villain until the end of 2001, committing offences of burglary. But he has got away from drugs and has a responsible job."

Magistrates gave Penny, who had five previous convictions for driving while disqualified, a further five-month ban as well as the jail term. They revoked a community punishment order he was given for previous offences and gave him no separate penalty for driving without insurance.

Penny was given a 42-day jail term in lieu of £2,000 of unpaid fines, to run concurrently with the four month term. He was ordered to pay £124.61 compensation.
