SCOTT WALKER missed from the spot with six minutes remaining as Chippenham failed to arrest their dismal home record on Saturday.
Keeper Mark Ovendale saved the spot kick after James Constable was brought down and Tiverton escaped with a point from a 0-0 draw.
The loss of more points at home saw the Bluebirds slip down the table from second to sixth.
The referee didn't help Walker's cause, stopping him as he ran-up to take the spot kick as he believed the ball had moved in the strong winds.
And official Martin Bryant had not endeared himself to the home side much earlier when Ben Kirk was hauled back in the box by Tiverton's Nathan Rudge.
"To be fair we did well and pressurised them for the whole game," said Chippenham boss Steve White, "But we still can't get that elusive home win.
"We had the chance of winning the game at the end but Scott Walker missed the penalty after the referee stopped him in his run-up the first time. The lad is distraught but he doesn't need to be it is just one of those things.
"I was still pleased with the performance and hope we can carry that forward."
This was the third Southern Premier Division meeting at Hardenhuish Park between these two old Screwfix League foes.
And since winning promotion to the Southern Premier Chippenham have yet to record a league win against the Devon side in five attempts.
More importantly they have now gone four months since registering a home league victory.
A lively derby, spoiled by a swirling and blustery wind, always had something to keep the crowd on their toes, even if it wasn't all goalmouth action. Apart from the penalty, Chippenham claimed a second one, were convinced a Gary Thorne header had crossed the line, and saw two all out fracas' and eight bookings.
Both sides found it difficult to make telling passes as a vicious cross wind swept diagonally across Hardenhuish.
Despite kicking up the hill and against the wind it was the home side who pinned their visitors back and created the better chances without reward.
The hour mark brought the first of two 16 man brawls after Walker and Ian Harvey tangled after a Chippenham raid had broken down.
A repeat performance followed a quarter of an hour from time when Matthew McEntegart's tackle floored Jamie Mudge. Punches were thrown but nothing more than yellow cards were shown, although Paul Milsom, the recipient of an earlier booking, appeared fortunate to escape a second as referee Bryant appeared to book Mudge in mistake for Milsom.
