A WARMINSTER man admitted his drunken behaviour had been out of order when he appeared before magistrates.
Kevin Mills, 20, of Portway Lane, was fined £160 and ordered to pay £43 costs after admitting a public order offence when he appeared at Chippenham magistrates' court on Thursday.
Michelle Hewitt, prosecuting, said police in Warminster town centre spotted Mills, who appeared to be 'eyeing up' someone on the other side of the road.
Miss Hewitt said: "As the police approached they noticed the defendant had a clenched fist. The defendant was being restrained by another member of the group who was saying 'leave it Kev, let's just go home'."
Mills claimed he had been hit in the mouth, but there was no sign of injury. He was warned about his behaviour and then arrested. The court heard Mills was given a 12-month conditional discharge in November 2003 for being drunk in public.
Defending himself, he said: "I'm sorry for what I did, there's no excuses for that. I was intoxicated and I was totally out of order."
