A property developer has been fined £4,000 for failing to comply with a listed building enforcement notice. Frank Faryab, of Oxford Street, Marlborough, appeared before Swindon Crown Court yesterday.
He pleaded guilty to failing to comply with the notice served on him by North Wiltshire District Council.
Simon Goodman, the council's barrister, told the court that Mr Faryab made applications for planning permission and listed building consent in respect of works to The Manse, 12 Oxford Street, Malmesbury.
This included creating dormer windows in the roof to the front of the building in July 1997.
The applications were refused but in November 1997 an application, which did not include the dormer windows, was approved, subject to conditions.
In June 2002 the council's senior conservation officer visited the property and saw that the windows were under construction.
Mr Faryab applied for permission to carry out the work but this was refused in September.
In February 2003 the council issued an enforcement notice asking Mr Faryab to remove the windows and certain other restoration works.
This notice was unsuccessfully appealed against in 2003 and the work should have been carried out by January 2004.
Defending, Warwick Tatford said Mr Faryab had been determined to fight the council's decision but, after taking legal advice, he realised he would have to comply with the enforcement notice and is planning to carry out the work. He was also told to pay court costs of £3,808.81.
