A farmer has appeared in court charged with leaving mud on a road which led to the death of Malmesbury Kebab shop owner Mesut Kayran.

George Withers, 37, of Moor Lane in Charlton, was ordered to return to Chippenham Magistrates Court on July 23 after the case was adjourned.

Mr Kayran, 28, of Gorse Hill, Swindon, was killed on October 23 when his Vauxhall Astra collided with another car at Sunset Hill on the B4014 whilst he was out making deliveries.

Mr Withers is charged with depositing mud on the highway on the day of the crash, causing injury or danger to users and of breaching a general duty to an employee.

The mud was cleaned off the road after the crash which happened about 8.40pm.

The B4014 near Brokenborough has seen a number of serious crashes over the years with its steep hill, sharp bend and junction creating a potentially treacherous stretch of road.

In December an investigation by the Independent Police Complaints Commission was opened following allegations the police had been told there was mud on the road hours before Mr Kayran’s crash.

After the crash his widow Noreen spoke of her grief.

She said: My husband was a friendly and generous man who was loved by everyone and had a wonderful sense of humour.

“He was an extremely hardworking business man.

"Mesut liked to play football with friends, spend time socialising and was very kind hearted.

“He was known as a person who was always willing to help and never said 'No' to anyone.

She added: "He treated my family as if they were his own and was a loving husband, son and brother but even more than that, he was my soul mate.

“We will miss him and love him always.”

The week before his death Mr Kayran had been the subject of racial abuse from Malmesbury man David Wicks, 46.

In March Mr Wicks was sentenced to 100 hours community service and told to pay £450 by Chippenham Magistrates Court.
